BY DOWNLOADING, INSTALLING, OPENING, OR USING THE APPLICATIONS, OR BY CLICKING THE ACCEPTANCE BUTTON IN THE INSTALLER, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS END USER LICENSE AGREEMENT. IF YOU DO NOT AGREE, YOU ARE NOT ENTITLED TO INSTALL OR USE THE APPLICATIONS AND MUST STOP THE INSTALLATION AND REMOVE THE APPLICATIONS FROM YOUR DEVICE.

1.2 Headings are for reference only and do not affect interpretation. The word "including" means "including without limitation". References to legislation include amendments and replacements. References to "in writing" include email.
Section 2Acceptance, Eligibility, and Electronic Contract
2.1 This Agreement binds You from the time You perform any of the acts described in the opening paragraph, whichever occurs first. Electronic acceptance constitutes a valid electronic contract under Law Number 11 of 2008 on Electronic Information and Transactions, as amended, and Government Regulation Number 71 of 2019 on the Implementation of Electronic Systems and Transactions. You shall not dispute the validity or evidentiary weight of this Agreement solely because it is in electronic form.
2.3 You represent and warrant that You are at least 18 years old or legally capable, that You use the Applications for business purposes, and, where You accept this Agreement on behalf of a Merchant, that You are authorized to bind the Merchant.
2.4 Operators and other End Users given access by the Merchant use the Applications under the Merchant's license and are bound by this Agreement. The Merchant shall ensure that Operators and End Users comply with this Agreement and shall inform them of the matters disclosed in Sections 7 to 10. By accepting the Merchant Agreement, the Merchant accepts this Agreement for itself and warrants that the End Users given access have been informed of and are bound by this Agreement.
2.5 Electronic records kept by Bakasir concerning acceptance of this Agreement, accounts, and Devices constitute valid evidence, without prejudice to Your right to prove otherwise.
Section 3Relationship to Other Documents and Order of Precedence
3.1 This Agreement governs the Applications software. Commercial matters, including Plans, Fees, service levels, and data ownership and processing, are governed by the Merchant Agreement, the Terms of Service, and the Privacy Policy.
3.2 In the event of conflict, the order of precedence is: (a) for matters specific to the Applications, this Agreement; (b) for other matters, the Merchant Agreement, then the Terms of Service; and (c) for the Processing of Personal Data, the Data Processing Addendum in the Merchant Agreement where Bakasir acts as Processor, or the Privacy Policy where Bakasir acts as Controller.
Section 4License Grant
4.1 Subject to this Agreement, Bakasir grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Applications on Devices paired to the Merchant's Terminals, solely for the Merchant's internal business operations, for as long as the Merchant's Subscription is active.
4.2 The license is tied to the Subscription and to the Terminal. The number of Terminals and Devices follows the Plan chosen by the Merchant.
4.3 The Applications are licensed, not sold. All rights not expressly granted in this Agreement remain with Bakasir and its licensors.
4.4 Owner mode in the Android Application is available only if the Merchant's Plan includes that feature, and shows only data according to the role and permissions of Your account.
Section 5Restrictions
5.1 You shall not, and shall not permit others to:
(a) disassemble, decompile, or reverse engineer the Applications, except to the extent applicable law expressly permits and that right cannot be waived by agreement;
(b) copy, redistribute, sell, rent, lend, or sublicense the Applications;
(c) modify Application files, remove proprietary notices, or interfere with the update mechanism;
(d) circumvent or disable license checks, Device pairing, PINs, Manager approvals, or Plan based feature limits;
(e) install the Applications on more Devices or Terminals than the Plan allows, or share Operator PINs and credentials;
(f) use the Applications to build or improve a product that competes with Bakasir, or publish benchmark results;
(g) distribute malicious software, or use the Applications for a business or activity prohibited under Annex F of the Merchant Agreement or applicable law;
(h) install the Applications from sources other than the official channels provided by Bakasir or official application stores.
5.2 These restrictions do not reduce Your rights under open source licenses for covered components (Section 13).
Section 6Installation, Updates, and Release Channels
6.1 The Desktop Application is installed per Windows user through an installer provided by Bakasir. The Android Application is installed from an installation file provided by Bakasir on the downloads page and, where available, from an official application store.
6.2 Automatic updates. The Desktop Application automatically checks for, downloads, and applies updates in the background from Bakasir's official release server. Updates may add, change, or remove features, fix security vulnerabilities, and adjust stored data. Updates to the Android Application follow the settings of the application store or distribution channel You use. By accepting this Agreement You consent to such updates. If an update materially changes the data an Application collects, Bakasir shall update the Privacy Policy or this Agreement and give notice under Section 22.
6.3 Release channels and withdrawal. Bakasir manages release channels and may withdraw a version and roll an Application back to a previous version if a defect or security risk is found. Bakasir may require a minimum version for an Application to continue synchronizing, and may raise minimum operating system requirements with reasonable notice.
6.4 Autostart and kiosk mode. The Owner or Manager may enable autostart when Windows starts and kiosk mode (full screen with window closing restricted). Under normal settings, closing the Desktop Application window hides it to the system tray and the Application keeps running; the Application stops completely only through its exit menu.
Section 7Device Pairing and Fleet Management
7.1 Pairing. A Device is paired to a Terminal with a Pairing Code from the Business Portal or by signing in as Owner or Manager on the Device. Pairing binds the Device to the Terminal and to the Merchant's account. The Pairing Code is confidential and valid only once and for a limited period.
7.2 Status data. While paired and running, the Desktop Application sends status data to Bakasir periodically, namely: Application version, operating system and platform, printer status, the size of the offline sales queue and the number of failed entries, the signed in Operator, and the kiosk mode and screen lock status. The Android Application does not send periodic status data as of the effective date of this Agreement; if that function is added, this Section applies equally. This data is used to show the Device's status to the Owner or Manager in the Business Portal, manage updates, support troubleshooting, and maintain security. Bakasir keeps only the latest status data of each Device (earlier values are overwritten and no history is kept), for as long as the Device is registered to the Merchant's account, and deletes it together with the account. Sending status data is part of fleet management and cannot be turned off separately while the Device is paired; the Merchant may stop it by unpairing the Device.
7.4 Merchant's responsibility toward Operators. The Merchant is responsible for informing its Operators that Devices are managed remotely, that Device status and the name of the signed in Operator are visible to Owners and Managers, and that cashier activity is recorded in audit logs. The Merchant shall ensure the legal basis and notices required under the Personal Data Protection Law and employment law. The Applications do not show Operators a separate notice; giving that notice is entirely the Merchant's responsibility.
7.5 Operator credentials. Operators sign in with a PIN and, where enabled, an RFID/NFC card. PINs are stored in a form that cannot be read back, cards are stored as keyed scrambled codes, and failed sign in attempts are limited. Operators shall not share their PIN or card.
Section 8Device Permissions and Hardware
8.1 The Applications may request or use the following permissions and resources only for the functions described:
(a) camera (Android Application): scanning barcodes and QR codes; scanning is processed on the Device and the Application does not store or upload camera images;
(b) Bluetooth, USB, local network, and serial ports: connecting receipt printers, cash drawers, scales, pole displays, customer displays, and barcode scanners;
(c) internet access: synchronization, updates, status data, and Bakasir services;
(d) local storage: the local database for offline mode (Section 9);
(e) notifications: approval requests, online orders, and other alerts; and
(f) second screen: the customer display may show items, totals, payment QR codes, and promotional slides to Merchant Customers. The Merchant is responsible for the Content displayed.
8.2 Operating system biometrics. The Merchant or an Operator may choose to unlock an Application with the operating system's biometric or PIN authentication. Face recognition, fingerprint, or operating system PIN is processed entirely by the operating system. Bakasir does not receive, store, or process biometric data or templates; the Application receives only the verification result (success or failure). This feature unlocks the same Operator session and does not replace the PIN for Manager approvals.
8.3 Third party hardware. Bakasir does not warrant that the Applications are compatible with every printer, drawer, scale, scanner, driver, or other device. The Merchant selects compatible hardware and is responsible for purchasing, installing, and maintaining it.
8.4 You may revoke permissions in the operating system settings; features that depend on a revoked permission will stop working.
Section 9Offline Mode and Local Data
9.1 Data on the Device. The Applications store on the Device a local database containing a copy of the product catalog and settings, held transactions, the receipt number counter, the offline sales queue, Operator identifiers and settings, and Device settings. On Windows the data resides in the Windows user profile; on Android it resides in application storage.
9.2 Offline sales. When there is no connection, the Applications can still record sales, which are then sent to the server automatically when the connection is restored. The Merchant is responsible for ensuring that Devices connect regularly and for monitoring the queue size shown in the Applications and the Business Portal.
9.5 Device security. The Merchant is responsible for the security of Devices: locking the screen, updating the operating system, enabling storage encryption, using separate user accounts, physically protecting Devices, and removing access for Operators who are no longer authorized. If a Device is lost or stolen, the Merchant shall immediately lock or unpair it from the Business Portal and change affected PINs.
9.6 Bakasir does not back up the local database on the Device. Data that has synchronized is stored on Bakasir's servers as set out in the Merchant Agreement.
Section 10Data and Privacy
10.1 Bakasir processes Personal Data as Controller for account, billing, security, and Device technical data as described in the Privacy Policy, and as Processor for Merchant Data as set out in the Data Processing Addendum in the Merchant Agreement.
10.2 Technical data generated by the Applications includes status data (Section 7.2) and diagnostic logs. Diagnostic logs and error records are stored locally on the Device. The Applications contain no third party crash reporting service and Bakasir does not send diagnostic logs automatically; logs reach Bakasir only if You share them.
10.3 The Applications store locally the Operator identifiers and session settings needed for Operators to sign in and work, and a copy of business settings (for example date format, logo, and branding).
10.4 Bakasir does not sell Your Personal Data and does not use Merchant Data to train third party artificial intelligence models.
Section 11Support, Compatibility, and Availability
11.1 Support and the Service availability target are set out in Annex E of the Merchant Agreement, including that the availability target carries no service credits.
11.2 Bakasir does not warrant that the Applications are compatible with every operating system, driver, hardware, mobile network, or third party configuration.
11.3 Some functions require a connection to the Service. Offline mode supports only the functions described in the documentation.
11.4 Bakasir may end support for certain operating system versions or platforms with reasonable notice.
Section 12Beta and Preview Features; Feedback
12.1 Features marked beta or preview are provided as is, may change or be discontinued at any time, and are not covered by any availability target or warranty.
12.2 If You provide suggestions, ideas, or feedback concerning the Applications, You grant Bakasir a royalty free, worldwide, perpetual, and irrevocable license to use them without obligation to You, without naming You, and without disclosing Your Personal Data.
Section 13Third Party and Open Source Components; Application Stores
13.1 The Applications contain third party and open source components. Each component is subject to its own license, most of which are permissive licenses. A list of components, copyright notices, and license texts is available on written request through [email protected]. If this Agreement conflicts with the license of a component, that component's license governs for that component. Third party components are provided by their owners without warranty, and Section 16 applies.
13.2 Application stores. If You obtain an Application from an application store, that store's terms also apply to You. This Agreement is between You and Bakasir only; the store operator is not a party to this Agreement, has no obligation to provide maintenance or support for the Application, and is not responsible for claims relating to the Application. A store operator may acquire rights as a third party beneficiary only to the extent its terms require.
13.3 Third party services that You connect, for example an authentication provider or the Merchant's own payment provider, are subject to their providers' own terms.
Section 14Intellectual Property
14.1 The Applications, the Bakasir trademark, and all intellectual property rights in them are owned by Bakasir or its licensors. This Agreement grants no rights in trademarks other than use of the Applications as intended.
14.2 Merchant Data remains owned by the Merchant as set out in the Merchant Agreement. The Merchant grants Bakasir the rights necessary to display the Merchant's Content within the Applications.
Section 15Term, Suspension, and Termination
15.1 This Agreement applies from when You accept it until it ends under this Section.
15.2 This Agreement ends automatically when the Merchant's Subscription ends (under the Merchant Agreement), when the Device is unpaired, or when the Application is removed. Bakasir may suspend or end the license if You breach this Agreement, if there is a reasonable security risk, or if the law so requires, with notice where possible and on a proportionate basis.
15.4 Sections 5, 9.3, 9.4, 12, 13, 14, 15.3, 16, 17, 18, 19, 22, 24, and 25 survive termination of this Agreement.
Section 16Disclaimer of Warranties
16.2 Nothing in this Agreement excludes or limits rights that cannot be excluded or limited under the law, including consumer rights under Law Number 8 of 1999 on Consumer Protection to the extent You qualify as a consumer.
Section 17Limitation of Liability
17.5 You are responsible for use of the Applications that breaches this Agreement, and the Merchant is responsible for the acts of its Operators and End Users, as provided in the Merchant Agreement.
Section 18Indemnification
18.1 You shall defend and indemnify Bakasir against third party claims (including reasonable fines and reasonable legal costs) arising from use of the Applications in breach of this Agreement or applicable law, or from Content You display through the Applications, except to the extent the claim is caused by Bakasir's breach or negligence.
18.2 Bakasir shall defend and indemnify the Merchant against third party claims alleging that the Applications, as provided by Bakasir, infringe third party intellectual property rights, excluding infringement arising from combination with other products, changes by You, or use in breach of this Agreement. In that event Bakasir may obtain the right for the Merchant to continue using the Applications, modify the Applications so they do not infringe, or, if that is not reasonable, end the license with a refund under the Merchant Agreement.
18.3 The party being claimed against shall notify the other in writing without delay, give it control of the defense, and cooperate reasonably. The indemnifying party shall not settle a claim that imposes obligations on the indemnified party without its consent.
Section 19Anti-Bribery, Sanctions, and Export Control Compliance
19.1 You shall not offer, give, request, or accept any bribe or improper advantage in connection with the Applications, and shall comply with applicable anti-corruption and anti-money laundering law.
19.2 You shall not use or transfer the Applications in breach of applicable export control and economic sanctions laws, including the laws of the Republic of Indonesia and the applicable sanctions of the United Nations, the European Union, and the United States. You represent that You are not on any sanctions list and are not located in a comprehensively sanctioned territory. Bakasir may restrict access where necessary to comply with the law.
Section 20Force Majeure
Neither party is in default for delay or failure to perform its obligations (other than payment obligations) caused by events beyond its reasonable control, including natural disasters, war, terrorism, riots, pandemics, fire, widespread power or network outages, public infrastructure failures, cyberattacks that could not be prevented despite reasonable security measures, or government action (force majeure). The affected party shall notify the other as soon as possible and endeavor to minimize the impact.
Section 21Notices
Bakasir's notices may be given through the Applications, the Business Portal, or email to the registered address, and are deemed received as provided in Section 31 of the Merchant Agreement. Legal notices to Bakasir shall be sent to [email protected] and the registered address in Section 26.
Section 22Changes
Bakasir may amend this Agreement. Material changes are notified at least 30 days before they take effect through the Applications, the installer, and/or email to the Merchant. If You do not agree, You may stop using the Applications before the change takes effect; continued use after that constitutes acceptance. Changes required by law or needed to close a security risk may take effect sooner. Changes do not apply retroactively to disputes that arose before their effective date.
Section 23Assignment and Subcontracting
You may not assign this Agreement without Bakasir's written consent. Bakasir may assign this Agreement to an affiliate or successor to its business with notice, and may use subcontractors while remaining responsible for performing its obligations.
Section 24General Provisions
24.1 Relationship of the parties. The parties are independent contractors. No agency, partnership, or joint venture exists. No third party has the right to enforce this Agreement, except the rights of application store operators under Section 13.2 and rights of Data Subjects given by law.
24.2 Waiver. Failure or delay in exercising a right is not a waiver of it.
24.3 Severability. If a provision is held invalid or unenforceable, the other provisions remain in force and that provision shall be interpreted or replaced by the one that comes closest to the parties' intention.
24.4 Entire agreement. This Agreement together with the documents named in Section 3 is the entire agreement concerning the Applications and replaces earlier arrangements on the same subject.
24.5 Claims period. Claims arising from this Agreement shall be notified in writing within 1 year from when the cause of action arises, to the extent the law permits, and claims not brought within that period are barred. This does not apply to payment obligations of Fees already due, to fraud, or to rights that cannot be limited under the law.
Section 25Governing Law, Dispute Resolution, and Language
25.1 This Agreement is governed by and interpreted under the laws of the Republic of Indonesia.
25.2 Disputes shall first be resolved through deliberation to reach consensus for 30 days from when either party gives written notice of the dispute. If that fails, the dispute shall be finally and bindingly resolved by arbitration of the Indonesian National Board of Arbitration (BANI) in Jakarta, before one arbitrator, under the BANI rules in force, in the Indonesian language. This does not prevent an application to the competent district court for interim measures.
25.3 This Section does not reduce the mandatory rights of Users in other jurisdictions under consumer protection and personal data protection law, including the right to complain to a data protection authority, and, to the extent You qualify as a consumer under Law Number 8 of 1999, the right to complain to a consumer dispute resolution body or to bring a claim before the courts as provided by that law.
25.4 This Agreement is made in Indonesian and English. If there is a difference, the Indonesian version prevails, in accordance with Law Number 24 of 2009 and Presidential Regulation Number 63 of 2019. The English text is a translation provided for convenience.
